These Terms and Conditions (hereinafter referred to as "Terms and Conditions") are provided by AKVATONS SIA (hereinafter referred to as "Seller") and determine the obligations and rights of online store users. Please read these Terms and Conditions carefully before using www.akvatons.lv.

For the purpose of these Terms and Conditions, a Buyer is a natural or legal person who purchases goods via www.akvatons.lv online store.

If the Buyer places an order or makes a purchase in the www.akvatons.lv online store, it shall be deemed that a distance agreement (hereinafter - the Agreement) is concluded between the Buyer and the Seller. The Agreement shall enter into force from the moment the Buyer has placed an order in the www.akvatons.lv online store and received an electronic order confirmation from the Seller, i.e. when the approval is available to the person to whom it is addressed. The contract remains in force until its completion, i.e. until full payment of the ordered goods and delivery of the goods to the Buyer.

Goods and prices of goods.

The buyer has the right to choose the method of payment and delivery of goods. Depending on the type of delivery, the cost of delivery is determined. The Seller has the right to unilaterally change the assortment and prices of goods in the online store www.akvatons.lv at any time. The price of the Goods must be the price that is shown on the goods and services at the time of placing the order. The price of goods shown on the website www.akvatons.lv may differ from the price of goods at the Seller's points of sale.

The goods displayed in the online store www.akvatons.lv may differ in color, size, shape or other parameters from the actual product characteristics. The images are for information only.

Ordering and payment.

Both registered and registered customers can order and purchase products offered in the www.akvatons.lv online store.

The buyer can pay for the goods in cash by picking them up at the address indicated by the seller: Katlakalna iela 1, Riga, LV-1073, or by bank transfer, it is necessary to take into account the time of bank operation, it can take 3 days. The goods are issued to the buyer only after receiving the money to the specified bank account of the seller. Your bank account number and details are listed in the order confirmation you received by e-mail.

The Seller has the right to refuse to sell the goods ordered on the website www.akvatons.lv, informing the Buyer, if:

the product is not available in Seller's warehouse or is not available in the order;

the price and parameters of the product do not match the actual product information due to a technical error in the system;

The Buyer is not familiar with the Terms and Conditions.

The Order is considered to be submitted after payment.

An order shall be deemed binding on the Buyer and the Seller at the moment when the Buyer has placed the order and received the Seller's confirmation by e-mail. The order and the acknowledgement of receipt shall be deemed received when the person to whom it is addressed has access.

The Buyer shall verify the information and data specified in the order. In case of any discrepancy in the information, the Buyer shall notify the Seller by e-mail: info@akvatons.lv. The order and confirmation of receipt may be saved or printed by the Buyer.

The online store Akvatons.lv offers to place an order online or to call us by phone 29269044 and we will deliver the ordered goods to you within 2-3 workdays, if the goods are in our stock.

Product Warranty.

The goods offered in the online store www.akvatons.lv are covered by the manufacturer's warranty.

All goods sold by the Seller at the purchase of the Buyer, who is a consumer, are guaranteed by the manufacturer in accordance with the procedure prescribed by the regulatory acts of the Republic of Latvia, provided that the instructions for use of the product are followed. Legal entities are guaranteed by the seller or the manufacturer.

When returning an item for warranty repair, the Buyer must attach to the item a warranty statement, receipt or invoice issued by the Seller indicating the defect or manifestation of the item. The warranty certificate is valid only if it correctly and clearly indicates the item, date of sale, warranty period, Seller's seal, and signatures of Seller and Buyer. It is forbidden to make any changes, delete or overwrite the data indicated in the warranty statement, as this will invalidate the voucher.

In order to receive the manufacturer's warranty service, the Buyer must deliver the goods to the service center specified in the warranty certificate or to the sales point "AKVATONS", Katlakalna iela 1, Riga, LV-1073. Warranty does not cover any replacements during warranty repair.

Costs related to the transportation of goods shall be borne by the Buyer. The warranty is valid as specified by the manufacturer in the product warranty.

If the Buyer is a consumer in accordance with the Consumer Rights Act, the Buyer has the right to sue the Seller for non-compliance of the goods with the terms of the contract in accordance with the procedure and within the prescribed time limits.

Free warranty repair is not available if the equipment is damaged as a result of manufacturer's malfunction and other defects are required which are not covered by the manufacturer's warranty repair and are attributable to the Buyer.

Goods are not covered under warranty, defective goods, damage caused by goods, willful damage, negligence, improper working conditions or failure to comply with the documentation of the purchase of goods (certificates) for goods, as well as damage or damage to information on the sticker or mechanical equipment manufacturer. in case of damage, whether caused by natural disaster, fire, household effects, accidental external factors, or product damage due to liquid, dust or foreign matter, or damage.

The warranty does not cover consumables, kits, and accessories.

If the warranty service is invalid and the buyer refuses to pay for the repair, the buyer will pay the cost of diagnosis and the buyer will receive the defect detection from the Service Center. If the buyer agrees to pay for the repair, the cost of diagnosis will not be covered.

Right of Withdrawal.

The Consumer, as defined in the Consumer Protection Act, may exercise the right of withdrawal and may, within fourteen (14) days, withdraw from the product purchased at www.akvatons.lv and return it to the Seller.

The period of exercise of the right of withdrawal begins on the date on which Buyer, or a third party other than the carrier, is designated by Buyer as the recipient in possession of the goods.

Buyer shall notify Seller of the decision to withdraw from the Contract prior to the expiration of the withdrawal period using the standard withdrawal form. Buyer may send the electronically completed withdrawal form to the email address: info@akvatons.lv or send it to Seller's point of sale.

Under the right of withdrawal, the Consumer may return the product within 14 days of purchase without giving a reason for the return.

The Seller shall, within fourteen (14) days from the date of receipt of the Buyer's notice of the decision to terminate the Contract and upon receipt of the return of goods, reimburse the Buyer the amount paid for the goods. The Seller shall reimburse the said amount by the same means of payment as the Buyer, unless otherwise agreed between the Buyer and the Seller.

The Seller shall be entitled to withhold reimbursement of the amount paid by the Buyer until the Seller has received the goods or the Buyer has provided the Seller with confirmation that the goods have been returned.

If Buyer expressly wishes to use a method of delivery other than the cheapest standard method of delivery offered by Seller, Seller shall not be obligated to reimburse Buyer for the cost of delivery.

Buyer's direct costs associated with the return of goods shall be borne by Buyer.

Buyer is responsible for maintaining the quality and safety of the goods throughout the term of the right of withdrawal. By exercising the right of withdrawal, the Buyer shall be responsible for any reduction in the value of the goods if the goods have been used in a manner inconsistent with good faith, including for purposes other than ascertaining the nature or effectiveness of the goods.

During the term of the Right of Withdrawal, Buyer may use the Product to the extent necessary to verify the nature, characteristics and performance of the Product (to the extent it can be done prior to purchase at the point of sale). Goods must be undamaged, unadorned (intact and undamaged labels, unopened protective films, etc.) AND unused. If the goods are not in their full packaging or in their original packaging, or the packaging of the goods is materially damaged (if it is impossible to open the packaging without damaging it), or the goods are damaged, the Seller is entitled to reduce the value of the goods The proportionate amount is calculated on the basis of the purchase price paid by the Buyer for the goods. The Seller shall notify the Buyer of the impairment of the goods by sending a notice to the email address specified in the order.

The Buyer shall return the goods to the Seller in the original packaging, in the same packaging in which it was received, together with the accompanying documents - warranty card (if any), instructions for use and other documents related to the goods.

The purchaser cannot exercise the right of refusal if:

the price of the product or service is subject to fluctuations in the financial marketplace that are beyond Seller's control and may occur during the term of the right of withdrawal;

the product is manufactured in accordance with Buyer's instructions or the product is clearly personalized;

Buyer has opened the package for a product that cannot be returned for health and hygiene reasons;

the product, because of its characteristics, is permanently mixed with other things after delivery;

 

The right of refusal does not extend to legal persons and persons who are not consumers within the meaning of the Consumer Protection Act.

Liability.

Seller shall not be liable for any costs, losses or damages that may arise from the use of the information provided in the www.akvatons.lv online store, or due to the fact that the product, website or online store www.akvatons.lv. is not available or the www.akvatons.lv online store has been damaged or closed for reasons.

Seller assumes no risk or liability if Buyer is unfamiliar or partially familiar with the Terms and Conditions and Privacy Policy.

Seller is not responsible for any discrepancy between the color, size, shape or other parameters of the goods shown in the images and pictures in the www.akvatons.lv online store and the actual characteristics of the goods.

Seller shall not be liable for any delays or defaults or other non-performance due to circumstances and obstacles beyond Seller's reasonable control, including but not limited to strikes, government orders, acts of war or national emergencies. such as environmental or climatic anomalies, third party default settings, Internet connection interruptions, communications equipment, computer hardware and software failures.

Other Provisions.

The Seller has the right to change and supplement the Terms unilaterally at any time. The Buyer shall comply with the Terms in force at the time of ordering the goods. Before each purchase the Buyer is obliged to read the Terms and Conditions. The Terms may be saved by the Buyer on a durable medium or printed.

The Buyer has no right to use the services of the online store www.akvatons.lv, if he has not read or does not agree with the Terms.

If the Buyer does not comply with the Terms, the Seller shall have the right to cancel or limit the Buyer's access to the online store www.akvatons.lv.

The Seller shall have the right to temporarily restrict access to www.akvatons.lv online store or terminate the operation of www.akvatons.lv online store altogether.

The Seller shall not store the concluded Contracts.

The www.akvatons.lv online store is the property of the Seller and is protected by the legislation of the Republic of Latvia.

Publishing, reproducing, transmitting or storing, changing or adding content of www.akvatons.lv online store (including but not limited to published materials, logos, images, graphics, etc. etc.) unless they are protected by copyright or the owner of the intellectual property rights has given his consent to such actions. This prohibition does not apply to downloading and storing content on a computer, tablet or smartphone and printing for personal (non-commercial) use only.

In case of violation of copyright of www.akvatons.lv online store, the Buyer could be held liable in accordance with the legislation of the Republic of Latvia.
